Return and Refund Policy

Visitors and users (hereinafter referred to as the Client) of the Online Reservation System for Dinner in the Sky Punta Cana on the Internet (hereinafter referred to as the System) agree to comply with the following terms of use (hereinafter referred to as the Terms) before purchasing any seat: The Organizer (Caribbean Rides) shall have the right to modify the Terms of use of the System by posting relevant information/news on www.puntacanadinnerinthesky.com.

Definitions and Interpretation

  • “Seats” refers to the seats on the platform.
  • “Event” refers to the Dinner in the Sky Punta Cana experience, which will take place at a location where we have the right to sell you seats.
  • Evidence (including electronic/online purchases) of our event sold by us to you.
  • “Location” means any facility or location of any nature where the event is held.
  • "The Organizer" means the organizer. "We" and "Our" shall be read accordingly.
  • "You" refers to the seat purchaser or any person who, in our reasonable opinion, is acting with your authorization or permission. "Your" shall be read accordingly.

Seats

  • All quoted prices are in US Dollars and do not include local taxes.
  • All seats are sold subject to availability and these terms and conditions. These terms and conditions must be read carefully before purchase, and any inquiries related to them must be raised with us before purchase, as purchasing seats constitutes acceptance of these terms and conditions.
  • You will receive confirmation of the seat(s) from the System via the email address provided by the Client in the System at the time of paying for the seat(s).
  • You will not be able to decide on the arrangement of the seats during the event.
  • To enter the event, a valid seat confirmation must be presented, and you must have passed and accepted the policies of the verification system adhered to the reservation platform of this website. The seat is valid only for the date of the event. Each seat admits one person only.
  • Removing, altering, or defacing any part of the seat confirmation may invalidate your seat. It is your responsibility to check your seat during the purchase process in our system. Any error made during the purchase cannot be corrected after the purchase. Please check your seat confirmation carefully and contact us immediately if there is an error at [email protected].
  • Resale of seats is prohibited. We reserve the right to cancel any seat or seats that have been resold.
  • Any use of the Dinner in The Sky Punta Cana System website, its content, and data for any illegal activity, as well as for the purpose of selling or reselling seats, for advertising or commercial purposes or otherwise to receive any benefit, including seat brokering, is prohibited without the prior written consent of the organizer.
  • Once seats are sold, no refunds or cancellations will be accepted.
  • The Organizer accepts responsibility only for seats purchased at one of its own managed points of sale.
  • Ownership or possession of a seat confirmation does not confer any right (implied or otherwise) to use, alter, copy, or otherwise deal with any of the symbols, trademarks, logos, and/or intellectual property appearing on the seat confirmation.
  • Any seat or seat confirmation obtained in breach of these terms and conditions shall be void, and all rights conferred or evidenced by such seat shall be void. Any person attempting to use such void seat to gain or provide entry to our event may be considered a trespasser and may be ejected and subject to legal action. Void seats are non-refundable.
  • By performing any action on the System site, the Client confirms that:
    • They are a natural person over 18 years of age, with full passive and active legal capacity to use the System.
    • They are a legal entity whose representative has all the powers to use the System's services on behalf of that person and assume any obligation for that legal entity.
    • They properly understand and comply with all the System's Terms of Use.
    • Minors must be accompanied by their legal guardian, who accepts the specific purchase conditions.

Session Duration

  • The total session duration is 90 minutes (15 minutes with the belt on, 60 minutes in the sky, and 15 minutes without the belt).

Price and Payment

  • The seat price will be the price set at the time we accept your order in US Dollars.
  • Please note that additional bank or credit/debit card fees may be charged per seat for certain features.

Changes to the Event

  • The Organizer may postpone, delay, cancel, interrupt, or stop the event due to adverse weather conditions, hazardous situations, or any other cause beyond their reasonable control.

Liability

  • If the event is delayed, canceled, or postponed, the Organizer is not responsible for expenses incurred by the client for travel, accommodation, or any other related services. Decisions to postpone or delay events are not under the control of the Organizer; therefore, we are not responsible and will not offer compensation or refunds for expenses incurred. A full refund (only for the seat price) will be granted if the Organizer cancels the event.
  • The client agrees that we will not be responsible for
    • any delay in delivery and/or non-delivery of any Seat confirmation; and
    • consequential damages of any nature. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES ARISING FROM OR RELATING TO YOUR PURCHASE OF A SEAT, EVEN IF SUCH DAMAGES ARE FORESEEABLE AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY THEREOF. IN NO EVENT SHALL OUR LIABILITY UNDER THIS AGREEMENT EXCEED THE PRICE OF THE SEATS YOU HAVE PURCHASED.

Event Cancellation or Rescheduling

  • It is your responsibility to check whether the event has been canceled or rescheduled, as well as the date and time of the rescheduling. In the event that an event is canceled or rescheduled, the organizer will make every effort to notify you.
  • A rescheduling fee of $10 per person plus tax will apply if the guest wishes to reschedule the booking within the last 24 hours before the original booking date.
  • If the guest does not show up for the reserved session, the rescheduling fee will apply if they are willing to reschedule.

Use of Data and Details

  • Information is collected from those who register in the system to facilitate the purchase of seats or other services available.

Admission Conditions

  • Guests must be at least 110 cm tall to attend the Dinner in the Sky Punta Cana event. If the guest is under 14 years old, they must be accompanied by an adult (the adult must be at least 18 years old).
  • Punctuality is very important for the Dinner in the Sky Punta Cana experience. It is recommended to arrive at least 30 minutes before the scheduled time indicated on your seat confirmation. If there is a delay in your arrival and the platform has already been raised, the Organizer will not lower the platform for you, and your seat will be automatically canceled without a refund.
  • It is recommended to dress according to the weather. Please note that at 50 meters high, the wind may be stronger and the temperature may be lower than usual. Once the platform has been raised, the organizer will not lower the platform if you request to change your clothes, shoes, etc.
  • The Organizer is not responsible for the medical peculiarities of each client in case of not providing such information. You will be responsible for your own health and safety and must observe all precautions related to your medical condition, including but not limited to diabetes, food allergies, etc., without any recourse against the Organizer.   • The Organizer reserves the right to refuse or deny you admission to the venue under reasonable circumstances, including health and safety issues, licensing reasons, or when a seat is vacant. The Organizer also reserves the right to ask you to leave the venue at any time for any reasonable reason and may take appropriate measures to enforce this right.

For example, the Organizer may expel any person who:
• behaved in a manner that, in the reasonable opinion of the Organizer, has affected or is likely to affect the enjoyment of other Clients; or
• uses threatening, abusive, or insulting words or behavior or in any way provokes or behaves in a manner that may disturb the peace of other Clients; or
• In the reasonable opinion of the Organizer, you are acting under the influence of alcohol or drugs.
• You must comply with the instructions and directions given by the Organizer, staff, and duty managers. No refunds will be given to those denied entry due to their own behavior, as suggested in the above examples, among others.
• You voluntarily assume all risks and dangers incidental to the event, whether occurring before, during, or after the actual event, including any death, personal injury, loss, damage, or liability.
• Dinner in the Sky Punta Cana does not limit in any way the participation of any disabled person, but such person MUST provide sufficient information (in writing) about their medical condition to the organizer before purchasing a seat. The organizer will assess the situation, and trained safety personnel will decide whether the person can participate.
• The health and safety of our Clients is our number one priority.

Event Safety Rules

  • The Organizer has the discretion to decide the table height once raised, based on the recommendation of our safety officer at any particular day or time.
  • In case of adverse weather conditions, the Organizer has the right to delay dinner (at the organizer's discretion, but with a maximum delay of 1.5 hours only without a refund). If the weather conditions do not improve, dinner will be canceled, and a full refund will be issued within 21 days if you purchase weather insurance, or if you do not have weather insurance, a voucher with the same monetary value will be issued for use at Dinner in the Sky Punta Cana.
  • For safety reasons, you must be at least 135 cm tall and a maximum weight of 150 kg to enjoy Dinner in the Sky.
  • We strongly recommend avoiding wearing open or unlaced shoes on the day of the event.
  • Seat belts are for your protection. Leave them as they are and do not attempt to open them at any time during dinner.
  • Throwing objects from the table at any time is strictly prohibited. Failure to comply with this condition will result in expulsion, and you will be asked to leave the venue at any time without a refund.
  • Smoking is strictly prohibited during the Dinner in the Sky Punta Cana experience. Failure to comply with this condition will result in seat purchasers being asked to leave the venue at any time, and no refund will be made.
  • Only small items, such as mobile phones or cameras, will be allowed on the table during dinner. Lockers will be provided for larger items, such as handbags. It is your responsibility to keep your personal belongings, such as mobile phones and cameras, safe. The organizer is not responsible for damages or losses of your items, if any.
  • You are required to comply and obey all instructions given by the Dinner in the Sky Punta Cana staff at all times. It is strictly prohibited to touch any operating device or machinery and may result in legal action.

Restrictions and Prohibitions

  • The Organizer reserves the right to use any photograph or video taken at any Dinner in The Sky® event without the express written permission of the individuals included in the photograph or video. The Organizer may use the photograph or video in publications or other media materials produced, used, or contracted by the organizer, including but not limited to: brochures, invitations, books, newspapers, magazines, television, websites, etc.
  • Anyone who does not wish to have their photograph taken or distributed must inform the Organizer in writing of their intentions and include their photograph. The Organizer will use the photograph for identification purposes and will keep it confidential.
  • The following items are not allowed within any venue:
    • Your own food and drink (unless permitted by the Organizer);
    • Bottles, cans, or glass containers (unless permitted by the Organizer);
    • Any item that may be interpreted as a potential weapon, including sharp or pointed objects (e.g., knives); and
    • Illegal substances
    • Professional/commercial recording devices
    • You agree to follow the instructions given by the Organizer's authorized staff to conduct any searches for prohibited items, including weapons, controlled/dangerous, and illegal substances.
  • The Organizer, the venue owner, sponsors, contractors, their agents, and employees will not be responsible for any death, personal injury, loss, or damage caused at the venue or during the Event, nor will they be responsible for any postponement of the dinner. The seat purchaser voluntarily buys and accepts the seat and assumes all risks and dangers incidental to the event, whether occurring before, during, or after the event, including death, personal injury, loss, damage, and liability.

Weather Conditions

  • The organizer has the right to postpone the session for 90 minutes due to bad weather; this will not be considered a canceled session, without a refund.
  • The Organizer has all the rights to cancel the Dinner In the Sky experience for weather-related reasons or for technical safety reasons (those who purchased weather insurance will be refunded the full amount within 21 days; those without weather insurance will be issued a coupon of the same value to use within the current event duration).

Refunds

  • Seats purchased cannot be refunded, exchanged, or canceled once issued, except in the case of cancellation by the Organizer.
  • If the Organizer cancels an event, the following situation will occur: For ONLINE buyers with a credit or debit card, we will work with their respective card banks to automatically debit the amount to their card. This process takes approximately 21 days after the Event; for cash buyers, we will refund the full amount in cash once the original receipt is available within 3 days.

Governing Law, Jurisdiction, and Dispute Resolution

  • The Agreement and these Conditions will be governed and interpreted in accordance with the applicable laws. The parties agree to submit to the exclusive jurisdiction of the relevant Courts concerning any dispute arising out of or under this Agreement.
